Withdrawal Agreement Legal Position

The EU air transport law, which was not applicable at Gibraltar Airport before the withdrawal agreement came into force, applies to Gibraltar Airport only from the date set by the Joint Committee. The Joint Committee takes the decision on this matter after the United Kingdom and Spain have indicated that they have reached a satisfactory agreement on the use of Gibraltar Airport. 2. In the event that the EU and the United Kingdom reach agreement on their future relations in the areas of the common foreign and security policy and the common security and defence policy, applicable during the transitional period, Chapter 2 of the EU Treaty and the acts adopted on the basis of these provisions apply to the United Kingdom from the date of implementation of this agreement. The 599-page withdrawal agreement covers the following main areas:[16] for the procedures covered by Article 29, paragraphs 2, 3 and 4, of the 2009/81/EC Directive; Article 33, paragraphs 2 to 5, directive 2014/24/EU and Article 51, paragraph 2, of directive 2014/25/EU; “custody rights” are custody rights within the meaning of Article 2 of Regulation (EC) No. 2201/2003 of the Council (6), including legal protection or the legal agreement reached by a judgment, which relate to the implementation of the following framework agreements concluded by contracting powers or awarding entities of the Member States or the United Kingdom. The UK`s official withdrawal from the EU came into force on 31 January 2020 (withdrawal date) at 11pm. On that date, the withdrawal period under Article 50 of the TUE ended and the ratified withdrawal agreement, which sets out the legal conditions for the UK`s withdrawal, came into force.
